Waiver & Liability Release

By completing and submitting the Application Form with the attached photo and video materials on the website, I confirm my full understanding of and agreement with the following:

1. I voluntarily agree to participate in the "USA Talent Show." The Administration of the show is under no obligation to invite me to participate in the Grand Final, as the Application Form constitutes a request to participate only. The Administration shall, at its sole discretion, determine which applicants advance to the live audition stage and the Grand Final. The Administration's decisions regarding my admission or non-admission to the Grand Final are final and not subject to appeal, challenge, or clarification. Should I be selected to participate in the live auditions and the Grand Final, the Administration shall be under no obligation to make any payments to me in connection with my participation in the show, unless otherwise expressly provided by the official prize pool.
2. Confidential information of the Administration includes any information regarding the Grand Final, the progress and results of the auditions, as well as details about interviewed individuals (excluding officially published information), which I undertake not to disclose or use; in the event of a violation, I undertake to fully compensate for the damages caused to the Administration.
3. All information provided by me in the Application Form or additionally transferred to the Administration is true, accurate, and non-confidential. I fully consent to its verification, collection, processing, and use, including publication across all digital and physical platforms of the show. In the event of providing false or incomplete information, the Administration reserves the right to reject the Application Form, as well as to disqualify me from participation or deny entry to the Grand Final, subject to my obligation to fully indemnify for any damages caused thereby.
4. I hereby grant the Administration full consent and permission to process and utilize my personal data by any and all means (including publication and public broadcast), with the right to sublicense and transfer such processing rights to third parties, and to make such data accessible to an unrestricted number of persons for any purpose, without limitation as to the storage duration. I acknowledge that I have been fully notified in writing of my statutory rights under applicable privacy legislation. I understand and confirm that my personal data will not be updated. I hereby confirm that I waive, now and in the future, any requirement for notifications regarding the processing or disclosure of my personal data to third parties, given the creative nature of the Administration's use of such data.
5. The Application Form (together with all submitted materials) shall remain the property of the Administration and shall not be returned to me, irrespective of whether I am selected to participate in the Grand Final. I hereby grant the Administration irrevocable permission to conduct photo and video recording of my participation in interviews, auditions, and the Grand Final; to utilize any photo and video materials submitted by me; to utilize all photo, video, and audio materials produced during the audition process; and to exploit my likeness, image, and voice by any means and in any medium, without limitation as to time or territory, with full rights of assignment and sublicensing to third parties.
6. I represent and warrant that the act/performance submitted by me for the Contest—and which I stand ready to re-perform at the auditions or during the Show itself—was conceived and prepared by me personally and is undertaken on my own initiative. I am thoroughly versed in both the theoretical and practical aspects of the execution of the act and am personally fully fit, physically and mentally, for its performance. I have fully reviewed and familiarized myself with all safety rules applicable to the execution of the act, have gathered all necessary information, and have taken all requisite preparatory measures. I am fully equipped with all technical equipment necessary for the execution of the act and with personal protective equipment to mitigate any risks during its performance.
7. I represent and warrant that there are no medical or technical contraindications to my execution of the act/performance that could lead to injury/harm or elevate the risk of incurring such damage.
8. I fully comprehend and acknowledge that the technical and operational specifics of executing the act/performance may be inherently dangerous. The performance may potentially lead to accidents (unforeseen and unpredictable events arising from any cause that may result in injury or impairment to my health through external trauma to bodily tissues or the musculoskeletal system, or result in death), as well as the onset, progression, or exacerbation of any medical conditions with any consequences, up to and including death. Notwithstanding the above, I hereby confirm that I assume all risks associated with the execution of the performance, including bearing sole responsibility in the event of any injury, impairment to my health, or death, particularly in pecuniary terms. Neither I nor any of my successors-in-interest, relatives, legal representatives, or assigns shall assert any claims or causes of action arising from damage to my health or loss of life, including any demands for damages or compensation of any nature, whether for my benefit or for the benefit of any third parties.
9. In the event of any damage caused during the performance due to my fault (intent, including any intentional actions that increased the risks of the performance, or negligence) or through no fault of my own (taking into account that the performance involves inherent risks/hazards), or if such damage occurs due to non-compliance with the guarantees provided by me, I shall be fully liable for such damage, regardless of the person harmed, including third parties, and regardless of the nature of the damage (material or non-pecuniary).
10. I confirm and guarantee that there are no restrictions on the Administration's use of intellectual property rights, including musical works, on my part and/or on the part of any third parties, which are incorporated into (used by) me in the performance or created as a result of my participation in the Contest. In the event of any third-party claims regarding the Administration's use of intellectual property items, I undertake to resolve such claims independently (at my own expense and effort) without involving the Administration. Should the Administration incur any losses in connection with such claims or disputes, I undertake to fully compensate for them.
11. I guarantee that I have full authority to complete and submit the Application Form, and to grant the rights and permissions set forth above without infringing upon the rights of third parties. The warranties and consents provided by me are valid; otherwise, the Administration shall have the right to claim compensation for damages incurred.
12. If a musical group or band qualifies to participate in the Grand Final, I guarantee that all the aforementioned rights, clearances, guarantees, and consents have been granted by all members of such group, all the aforementioned information is known to and accepted by all members of the group, and all obligations are undertaken by each member of the group (otherwise, the Administration shall have the right to claim compensation for damages incurred).
13. If a candidate for the auditions and the Grand Final is under 18 years of age, the Application Form on the website may be completed only by their legal representatives (parents or guardians). In this case, by completing the Application Form, the legal representatives agree to the terms of the Rules and assume all rights and obligations on behalf of the candidate.
14. I have read and fully agree to the Show Rules and the Waiver & Liability Release provided by the show organizers.
15. I confirm that this act is safe for family viewing and does not contain profanity, offensive content, or dangerous elements. (Family-Friendly).
